Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BITE mobile application and website (collectively, the "Service") operated by Nutriflex Systems ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use BITE. By using the Service, you represent that you meet this requirement. If you are under 18, you confirm that your parent or guardian has consented to these Terms on your behalf.

2. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at nutriflex.systems@gmail.com if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and billing

BITE offers a free tier and a paid Pro subscription. By subscribing to Pro, you authorise us to charge the applicable fee to your chosen payment method on a recurring basis until you cancel. Prices are shown in GBP and may include applicable taxes. We may change prices with 30 days' notice; continued use after a price change constitutes acceptance.

You may cancel your subscription at any time through the app or your account settings. Cancellation takes effect at the end of the current billing period and you retain Pro access until then. We do not provide refunds for partial periods except where required by law or at our sole discretion.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse-engineer, decompile, or extract source code from the app
• Use automated tools to scrape, crawl, or excessively load our systems
• Upload or transmit malicious code, viruses, or any content that is harmful or offensive
• Misrepresent your identity or impersonate another person
• Resell or commercialise any part of the Service without our written permission

5. AI-generated content and Mr. Bite

BITE uses artificial intelligence to generate meal plans, recipe suggestions, and responses through Mr. Bite. AI-generated content is provided for informational purposes only. It is not a substitute for professional medical, dietary, or nutritional advice. Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your individual circumstances. You use AI-generated content at your own risk.

6. Intellectual property

All content, design, code, and trademarks in the Service — including the BITE name and logo — are owned by Nutriflex Systems or our licensors and are protected by intellectual property law. You may not copy, distribute, or create derivative works without our express written consent.

You retain ownership of any content you create or upload (e.g. custom recipes, diary entries). By submitting such content, you grant us a limited, non-exclusive licence to store and process it solely for the purpose of delivering the Service to you.

7. Third-party services

The Service integrates with third-party services including Clerk (authentication), Supabase (database), Stripe (payments), Anthropic and DeepSeek (AI), Edamam and Spoonacular (food data), and Sentry (error monitoring). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability or conduct of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NUTRIFLEX SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Nutriflex Systems and its officers, directors, employees, and agents from any claims, losses, damages, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time without notice. We may update these Terms from time to time. When we make material changes, we will notify you via the app or email. Your continued use after the effective date constitutes acceptance of the updated Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases and we may delete your data subject to our Privacy Policy.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
